Photography Contract Terms:

The Client listed above, and Mak’s Photography agree that Mak’s Photography will provide Professional Photography Services for the session described in this contract. This contract represents the entire understanding of the requirements, schedule, and payment terms for Mak’s Photography’s services.

Photographer’s Rights/Client’s Rights:

Mak’s Photography reserves all intellectual and ownership rights to all images captured. The Client’s rights to the images provided shall not supersede Mak’s Photography’s rights to ownership. Mak’s Photography may use all images captured for demonstration, advertising, or other purposes so as to promote and attract new Clients. The Client will under no circumstances be compensated for the use of their photos captured by Mak’s Photography. The images provided to the Client are licensed for personal purposes only. The license does not include use that results in financial gain. The Client may NOT under any circumstances alter, edit, or change any of the images provided to them. This includes any and all SOCIAL MEDIA FILTERS, including making images black and white.

Payment:

The Client agrees to pay Mak’s Photography for the Professional Photography Services provided as described above by the signing of this Contract. The Client understands that all payments made prior to the session are NON-REFUNDABLE. Any additional goods or services not included in this contract will be sold at then current rates. Mak’s Photography makes no pricing guarantees outside of the terms of this Contract. The Client acknowledges that prices of additional goods and services are subject to change suddenly and without notice. The Client understands that the day of session balance, if not paid in cash, will have a 6% sales tax applied if paid electronically via Venmo or Cashapp. The Client understands that Mak’s Photography DOES NOT accept checks.

Rescheduling/Cancellation Policy:

The Client agrees to be present at the location on the date and time stated in this contract. The Client understands

that failing to be present at the location on the date and time stated above may result in the Client’s session being rescheduled or canceled. If the Client chooses to reschedule the session Mak’s Photography will accommodate to the Client’s requested reschedule date if Mak’s Photography has availability for the date being requested. The Client may reschedule up to two times with no additional fees. The Client will be required to pay half of the remaining session fee when rescheduling for the first time and will be required to pay the other remaining half if they must reschedule a second time. Any additional request to reschedule will result in a $50 fee each time. Mak’s Photography is not responsible for reaching out to a Client about rescheduling the Client must contact Mak’s Photography and request a new date. If the Client chooses to cancel all payments made prior to session are non-refundable.

Liability of Images:

Mak’s Photography agrees to make every effort to provide satisfactory images, but cannot make any guarantees as to specific photos, poses, etc. Mak’s Photography is not liable for any images not included in the completed digital album. In the case of any loss, damage, or theft of footage, Mak’s Photography will work with the Client to remedy the situation. Mak’s Photography will not be held liable for compromised images due to interference from other parties such as traffic in public spaces, guest, amateur photographers, videographers, or other professional photographers. Likewise, Mak’s Photography is not liable for degraded images due to environmental issues, such as poor lighting, spaces, or backdrops provided by the Client. Furthermore, the Client agrees that Mak’s Photography will not be held legally, financially, or emotionally responsible for any of the situations listed in this section.

Image Processing/Digital Album:

Mak’s Photography will perform basic color correction and retouching to the number of images provided for the session described above prior to delivering the Client’s digital album. Any major editing manipulations requested may result in additional fees. The Client acknowledges that Mak’s Photography does not maintain archives of images after 30 days upon delivering the finalized album.

Injury, Illness, Damage, Theft, or Loss Liability:

The Client acknowledges that Mak’s Photography and other parties involved including but not limited to the photographers, owners of property being used, and assistants present will be held harmless and not held liable for any death, disability, personal injury, personal illness, property damage, property theft, property loss, or actions of any kind that may occur during or traveling to and from the session/event described above. If during the course of the session, any of the equipment owned by Mak’s Photography is damaged, stolen, or lost due to the fault of any persons involved with the Client, the Client is responsible for payment to replace and or repair said equipment within 90 days following the session.

Venue Policies:

It is the responsibility of the Client to secure the permission of the venue or other officials to photograph the Client’s session. The Client understands that if a venue limits Mak’s Photography’s placement and movement the quality of the final product may suffer. The Client understand they are responsible for any and all location fees.
