Event Contract

Agreement To Hire:

Upon full payment of the Booking Deposit and the signing of this Contract, the Client, whose name is listed on the first page of this Contract, is guaranteed to have Mak’s Photography photograph their event on the date stated on the first page of this contract. By the signing of this Contract the Client agrees that Mak’s Photography is the exclusive Professional Photographer for the event described in this Contract and no other Professional Photographer will be present.

Photographer’s Rights/Client’s Rights:

Mak’s Photography reserves all intellectual and ownership rights to all images captured. The Client’s rights to the images provided shall not supersede Mak’s Photography’s rights to ownership. Mak’s Photography may use all images captured for demonstration, advertising, or other purposes so as to promote and attract new Clients. The Client will under no circumstances be compensated for the use of their photos captured by Mak’s Photography. The images provided to the Client are licensed for personal purposes only. The license does not include use that results in financial gain. The Client may NOT under any circumstances alter, edit, or change any of the images provided to them. This includes any and all SOCIAL MEDIA FILTERS, including making images black and white.

Payment:

The Client agrees to pay Mak’s Photography for the Professional Photography Services provided as described above by the signing of this Contract. The Client understands that all payments made prior to the event described in this Contract are NON-REFUNDABLE. Any additional goods or services not included in this contract will be sold at then current rates. Mak’s Photography makes no pricing guarantees outside of the terms of this Contract. The Client acknowledges that prices of additional goods and services are subject to change suddenly and without notice. The Client understands that the day of wedding balance, if not paid in cash, will have a 6% sales tax applied if paid electronically via Venmo or Cashapp. The Client understands that Mak’s Photography DOES NOT accept checks.

Client Cancelation/Rescheduling Policy:

If the Client should decide to cancel the event described in this Contract, all payments made prior to the cancellation are NON-REFUNDABLE. Should the Client decide to reschedule the event described in this Contract, Mak’s Photography will accommodate this rescheduling if Mak’s Photography has availability for the new date. Mak’s Photography requires a rescheduling fee of 20% of the original package total stated in this contract. Mak’s Photography will make every good faith effort to provide the services described in this Contract. Should Mak’s Photography not be able to be present at the Client’s event described in this Contract, Mak’s Photography is responsible for finding a qualified replacement.

Delivery Timeline:

The Client is guaranteed to receive their completed album within 120 days from the event. An Online Album will be made available to the Client throughout the editing process allowing the Client access to the images as they are completed by Mak’s Photography. Once the album is finalized the Client will have 30 days to extract the Online Album to their own personal device. The Online Album will no longer be available to the Client after 30 days from the day the album is finalized. If the Client’s Package includes a flash drive or a flash drive was purchased for the event through Mak’s Photography, the Online Album will remain available to the Client until the Client receives their flash drive.

Liability of Images:

Mak’s Photography agrees to make every effort to provide satisfactory images, but cannot make any guarantees as to specific photos, poses, etc. Mak’s Photography is not liable for any images not included in the completed digital album. In the case of any loss, damage, or theft of footage, Mak’s Photography will work with the Client to remedy the situation. Mak’s Photography will not be held liable for compromised images due to interference from other parties such as traffic in public spaces, guest, amateur photographers, videographers, or other professional photographers. Likewise, Mak’s Photography is not liable for degraded images due to environmental issues, such as poor lighting, spaces, or backdrops provided by the Client. Furthermore, the Client agrees that Mak’s Photography will not be held legally, financially, or emotionally responsible for any of the situations listed in this section.

Image Processing/Digital Album:

Mak’s Photography will perform basic color correction and retouching to the number of images provided for the session/event described above prior to delivering the Client’s digital album. Any major editing manipulations requested may result in additional fees. Mak’s Photography is not responsible for printed copies of provided images. The Client acknowledges that Mak’s Photography does not maintain archives of images after delivering the Client’s completed flash-drive.

Damage, Theft, or Loss Liability:

If during the course of the session, any of the equipment owned by Mak’s Photography is damaged, stolen, or lost due to the fault of any persons involved with the Client, the Client is responsible for payment to replace and or repair said equipment within 90 days following the Client’s event.

Venue Policies:

It is the responsibility of the Client to secure the permission of the venue or other officials to photograph the Client’s event. The Client understands that if a venue limits Mak’s Photography’s placement and movement the quality of the final product may suffer.

Crew Care Policy:

Mak’s Photography and their team reserves the right to eat and take brief breaks throughout the duration of the event. By signing this contract the Client is agreeing to provide food and refreshments to Mak’s Photography and their team.
